Justice Donatus Okorowo of the Federal High Court in Abuja has ruled to disqualify Mr. Timipre Sylva, the All Progressives Congress (APC) candidate in the upcoming November 11 governorship election in Bayelsa State.
The judge cited a breach of the 1999 constitution as amended, as Sylva had previously been sworn in twice and served five years as the state’s governor.
Justice Okorowo argued that allowing Sylva to contest again would violate the constitutional provision that restricts a person from being elected as governor more than twice.

The judge referenced the Supreme Court’s decision in the case of Marwa vs. Nyako, which affirmed the constitutional limit on gubernatorial terms.
The case was initiated by Mr. Deme Kolomo, a member of the APC, on June 13, 2023.
