You can’t get 50% of husband’s properties after divorce under Nigerian laws – Lawyer tells women

AGS NEWS – Activist lawyer Madubuachi Idam stated on Thursday that Nigerian law does not support the idea of a woman receiving 50 percent of her husband’s property during a divorce.

He cautioned women who enter into court marriages with the intention of sharing their husband’s assets that this is not recognized under Nigerian law.

In an interview with AGS NEWS, Idam explained that to claim any part of a husband’s property during a divorce, the spouse must provide clear evidence of having contributed to the acquisition of that property.

Idam emphasized, “The law that awards 50 percent or any percentage of a man’s property to his wife during divorce is not recognized in Nigeria.

Women who push for statutory (court) marriages with the hope of sharing in their husband’s property during a divorce should be aware that this is not supported by Nigerian law.”

He clarified that while a spouse is entitled to inherit property in the event of the other’s death, the same entitlement does not apply in the case of divorce unless there is substantial proof of contribution to the property.

Idam also noted, “Laws are territorial, and what applies in other countries, like the UK, does not automatically apply in Nigeria unless it is legislated here.

If the goal of a statutory marriage is to secure a share of wealth in a divorce, that expectation may not align with Nigerian law.”
