Trump cleared to run for president after Supreme Court victory

AGS NEWS – The United States Supreme Court has ruled that states lack the authority to prohibit Donald Trump from running for president.

Trump will be included on the ballot for Tuesday’s primary election in Colorado. This ruling marks a significant victory for the former president, who is widely anticipated to secure the Republican nomination during the Super Tuesday contest.

The Supreme Court’s decision, published on Monday, reverses an earlier ruling in Colorado, asserting that the responsibility for enforcing Section 3 of the 14th Amendment against federal officeholders and candidates lies with Congress, not individual states.

Section 3, established after the Civil War in 1868, aims to prevent former officeholders who participated in insurrection from regaining power.

The court emphasized that while states can disqualify individuals from holding state office, they lack the constitutional authority to enforce Section 3 concerning federal offices, particularly the presidency.

Trump promptly celebrated the ruling on Truth Social, expressing it as a “big win for America.”

The court emphasized that granting states the power to disqualify federal candidates would lead to chaotic inconsistencies across states, potentially disenfranchising millions of voters and disturbing election results.

Justice Amy Coney Barrett, writing on behalf of the court, urged for a calm resolution of this politically charged issue, emphasizing the importance of maintaining national stability during presidential elections.

The three Democratic justices argued against the Colorado ruling, warning against creating a fragmented, state-by-state framework that contradicts federal principles.
