Naira Marley and Sam Larry file lawsuit against magistrate, seek N40m in damages

Controversial musician Naira Marley, whose real name is Abdulazeez Fashola, and Lagos socialite Samson Eletu, known as Sam Larry, have taken legal action by filing a fundamental rights suit to contest their prolonged detention in connection with the death of 27-year-old singer Ilerioluwa Aloba, also known as Mohbad.

The suit was lodged before the Federal High Court in Lagos, with the police and Lagos magistrate Adeola Olatunbosun, who issued the order for their detention in police custody for 21 days, named as defendants.

Both Naira Marley and Sam Larry are seeking damages of N20 million each from the defendants.

Their lawsuit, represented by their lawyer, Mr. Olalekan Ojo (SAN), seeks a declaration from the court that their continued detention since October 4, 2023, at the Homicide Section of the Lagos State Police Command, Panti, Yaba, Lagos State, is a violation of their rights.

They are also requesting “an order of the court for their immediate release.”

In affidavits attached to their suits, deponents stated that their troubles began between October 3 and 4, 2023, when they were apprehended by the police due to their alleged connection with the death of Ilerioluwa Aloba, also known as Mohbad.

“On the 4th day of October 2023, the Commissioner of Police sought an order in the Magistrates’ Court, held at Yaba, to detain them for 30 days.

“Chief Magistrate Adeola Olatunbosun granted the police’s application to detain them for only 21 days in police custody.

“The 21-day detention order, granted by Chief Magistrate Olatunbosun, has since lapsed on October 26, 2023, and the order has not been renewed.”
