The witness, testifying before Justice Abiola Soladoye, revealed that it was the defendant’s son, Usman, the victim’s younger brother, who witnessed the alleged assault and raised the alarm.
She stated, “Abiodun was at home with his daughter (the victim), his younger brother, and a visitor who came to visit.
After the visitor left, Usman was chased out by his father, and the defendant told him to leave the house. When he left, Abiodun removed his daughter’s pants, held her neck, and attempted to assault her.

It was during this act that the daughter screamed. Her brother heard the commotion and entered the house, where he witnessed his father on top of his sister.”
Eyo further detailed, “The defendant tried to send Usman away, but the victim ran out and reported to their neighbor that her father was attempting to engage in a sexual act with her.
The neighbor subsequently reported the case to the Baale (local chief), before it was reported to the Lagos State Police Badagry Division.”
Subsequently, Justice Abiola Soladoye adjourned the case to December 16, 2023, for the continuation of the trial.

The defendant had been arraigned on June 3, 2021, on a charge of unlawfully defiling a child, as filed by the state. This alleged offense took place at their residence in the Badagry area of the state.
According to the prosecutor, the act contravenes Section 137 of the Criminal Law of Lagos State, 2015. The defendant, however, pleaded not guilty to the charge against him.
