Judiciary shouldn’t decide election winners – Femi Falana

Human rights lawyer Femi Falana, SAN, emphasized that it is the exclusive responsibility of the Independent National Electoral Commission (INEC) to determine the winners of elections in Nigeria, not the judiciary.

Falana made these comments in the wake of the Supreme Court’s decision to uphold President Bola Tinubu’s victory in the February 25 presidential election while dismissing petitions from Atiku Abubakar and Peter Obi.

Although the Supreme Court’s judgment concluded the presidential election, Falana argued that it does not represent a judicial endorsement of INEC’s conduct in the election.

He stressed that the country still has a long way to go in achieving credible and acrimony-free elections, urging an end to the practice of allowing the judiciary to decide election outcomes.

Falana insisted that the task of determining election winners should remain the exclusive purview of INEC, as long as the political class is honest and committed to transparent elections.

He called on Nigeria to set good standards for other black communities and avoid global embarrassment.
