The Supreme Court has rejected an appeal filed by the All Progressives Congress (APC) and its candidate, Uche Nnaji, in the Enugu State governorship election.
They were challenging the victory of Governor Peter Mbah, who ran as a candidate of the Peoples Democratic Party (PDP).
During the election, Uche Nnaji secured 14,575 votes, placing a distant fourth against Peter Mbah’s 160,895 votes.
Nnaji alleged that Mbah, Chijioke Edeoga of the Labour Party, and Frank Nweke Jr. of the All Progressives Grand Alliance were unqualified to contest, citing violations of asset declaration laws and other claims.

However, the Enugu State Governorship Election Petitions Tribunal dismissed Nnaji’s petition on June 20, 2023.
Dissatisfied with this decision, Nnaji appealed to the Court of Appeal, seeking to return the dismissed petition to the Tribunal for further review.
The Court of Appeal in Enugu upheld the Tribunal’s ruling, and Nnaji and the APC were each fined N250,000.
In delivering the Supreme Court’s judgment, a five-member panel stated that the legal team of the APC and Nnaji submitted an invalid brief of argument and failed to provide convincing reasons for the court to accept their flawed brief.
Consequently, the Supreme Court dismissed both the brief and the appeal filed by the appellants.
