Justice Binta Nyako of the Federal High Court granted Nnamdi Kanu, the detained leader of the Indigenous People of Biafra (IPOB), permission to have access to the medical doctor of his choice while in the custody of the State Security Service.
The court ruled that Kanu has the right to choose his medical practitioner, but he would be responsible for the expenses incurred.
While under investigative custody of the DSS, Kanu is entitled to medical examination, which he must bear the cost of.
Kanu filed a suit through his legal team, led by Prof. Mike Ozekhome, SAN, seeking an order of mandamus to compel the security agency to grant him unrestricted access to his private physicians and medical records.
The court held that the medical examination outside the DSS facility should be overseen by Kanu’s team of doctors, and the reports must be sealed for security reasons.
