Court of appeal dismisses lawsuit filed by Enugu APC governorship candidate against Peter Mbah

The Court of Appeal has dismissed the lawsuit filed by Uche Nnaji, the governorship candidate of the All Progressives Congress (APC) in the 2023 general election in Enugu state.

Nnaji contested the victory of Dr. Peter Mbah of the Peoples Democratic Party (PDP), claiming that Mbah was not constitutionally qualified to run for governor and had presented a forged certificate to the Independent National Electoral Commission (INEC).

Nnaji also argued that Governor Mbah was not duly elected by the majority of lawful votes cast.

However, the three-man panel of the appellate court upheld the decision of the Tribunal, stating that the lawsuit was not filed in accordance with the provisions of the Electoral Act.

As a result, the lawsuit was dismissed.
